Stato di emergenza illegittimo, violati i diritti costituzionali: la giudice di Pisa fa a pezzi i Dpcm Covid.
La giudice di Pisa Lina Manuali ha assolto un cittadino dall’accusa di avere violato un Dpcm per essere uscito di casa durante la pandemia. «Con il susseguirsi, spesso in contrapposizione tra loro, di decreti legge e Dpcm si è assistito all’introduzione di sempre più stringenti restrizioni e limitazioni nell’esercizio delle libertà e dei diritti fondamentali, fino ad arrivare a incidere sul diritto al lavoro e a un’equa retribuzione con violazione dell’articolo 36 della Costituzione», è quanto si legge nelle motivazioni, depositate due giorni fa, alla sentenza pronunciata nel novembre scorso. Tra le altre cose, il magistrato afferma che la delibera datata 21 gennaio 2020 con cui il Consiglio dei Ministri stabilì lo stato di emergenza era «illegittima» e, di conseguenza, lo sono stati tutti i provvedimenti che ad essa si richiamavano e tutte le proroghe dello stato di emergenza.
Anche per questa ragione, Manuali ha assolto un cittadino ‘perchè il fatto non sussiste’ dal reato di ‘inosservanza’ dei provvedimenti dell’autorita «per avere violato il divieto di uscire di casa se non per motivi di lavoro, salute o necessita». Non è la prima sentenza che stabilisce l’illegittimità dei Dpcm ma è una delle più articolate e si spinge fino ad alludere, mettendole in dubbio dal punto di vista giuridico, alle limitazioni sul lavoro per chi non è in possesso del green pass. Centrale nel ragionamento del giudice il concetto di «stato di emergenza». Il punto di partenza è che «l’ordinamento costituzionale italiano non contempla né lo stato di eccezione, né lo stato di emergenza al di fuori dello stato di guerra» e la «la situazione causata dal Covid non è giuridicamente assimilabile allo stato di guerra».

The judge of Pisa Lina Manuali acquitted a citizen from the charge of having violated a Dpcm for having left home during the pandemic. "With the succession, often in opposition to each other, of decrees and Dpcm we have seen the introduction of increasingly stringent restrictions and limitations in the exercise of freedoms and fundamental rights, until you get to affect the right to work and a fair wage in violation of Article 36 of the Constitution," is what you read in the reasons, filed two days ago, the sentence pronounced last November. Among other things, the magistrate states that the resolution dated January 21, 2020 with which the Council of Ministers established the state of emergency was "illegitimate" and, consequently, so were all the measures that referred to it and all extensions of the state of emergency. Also for this reason, Manuali acquitted a citizen 'because the fact does not exist' from the crime of 'non-compliance' with the measures of the authority "for having violated the prohibition to leave the house except for reasons of work, health or needs". This is not the first sentence that establishes the illegitimacy of the Dpcm but it is one of the most articulated and goes so far as to allude, questioning them from a legal point of view, the limitations on work for those who are not in possession of the green pass. Central to the judge's reasoning is the concept of a "state of emergency". The starting point is that "the Italian constitutional system contemplates neither a state of exception nor a state of emergency outside the state of war" and that "the situation caused by Covid is not legally comparable to a state of war".
